Sydney traffic law FAQs
Traffic offences such as drink driving are considered a criminal offence. Charges for drink driving will typically occur if the blood alcohol concentration (BAC) in your breath is higher than the prescribed amount.
It is important to note that the prescribed BAC amount will differ for some individuals. For example, the prescribed concentration for drivers with a full licence is 0.05 or higher whereas those driving with L Plates or P Plates are required to have a BAC of zero.
Certain road rules and traffic laws apply to all properties, whether they are public or private. This may include very serious traffic offences, such as those where a vehicle is deliberately used to cause injury.
When driving on private property that is not widely open to the public, there are some driving laws which may not apply such as speeding or in some situations, drink driving. It is important to note the distinction between private property, where these laws may not apply and a private road- which is open to the public for driving- where these laws do in fact apply.
