Drug Manufacturing Lawyer Sydney
Experienced Lawyers Defending Drug Manufacture And Cultivation Charges In Sydney
Manufacture and cultivation charges are treated more seriously than possession because the law targets production rather than use. They also frequently involve premises, equipment and other people, which means the central question is often what your actual role was.
At Hugo Law Group, our Sydney lawyers defend manufacture, production and cultivation charges under the Drug Misuse and Trafficking Act 1985 (NSW), including matters involving precursor chemicals and equipment found at a property.

Charged With Drug Manufacture Or Cultivation In Sydney?
These charges usually arise after a search of a house, garage or storage unit, and the prosecution has to connect you to the production rather than simply to the address.
Your matter may turn on:
- Whether you knew what was happening at the premises, particularly in a shared or rented property
- Whether your role amounted to manufacture or something less, such as being present
- The number of plants or the quantity alleged, since these determine the tier and the court
- Whether the equipment or chemicals found are genuinely capable of the use alleged
- Whether the search of the premises was lawfully conducted
Cultivation charges involving cannabis are measured by the number of plants rather than by weight, and the thresholds that lift a charge into the commercial tiers can be reached more easily than most people expect.
How Our Sydney Drug Manufacturing Lawyers Can Help
These cases are built from what was found at a location, so the link between you and that location is where the work is.
Our team can assist by:
1. Testing The Link To The Premises
Being an occupant, a tenant or a visitor is not the same as producing drugs. We examine what evidence actually connects you to the production rather than to the address.
2. Examining The Search Of The Property
Searches of premises generally require a warrant, and warrants have requirements. We examine whether the search was properly authorised and conducted within its terms.
3. Assessing Your Alleged Role
Where several people are charged, the prosecution’s description of your role drives your exposure. We test whether the evidence supports the role attributed to you.
4. Challenging The Quantity Or Plant Count
The number of plants or the quantity produced determines the tier and therefore the maximum penalty. We check how that figure was arrived at and whether it holds up.

Manufacture And Cultivation Charges We Defend In Sydney
Our lawyers act across the range of production allegations in NSW.
Manufacture or production of a prohibited drug
The core offence under s 24 of the Drug Misuse and Trafficking Act 1985 (NSW), covering the process of producing a prohibited drug.
Cultivation of prohibited plants
Charges under s 23 of the Drug Misuse and Trafficking Act 1985 (NSW), involving growing cannabis or other prohibited plants, measured by plant count.
Enhanced indoor cultivation
Charges under s 23(1A) of the Drug Misuse and Trafficking Act 1985 (NSW), alleging cultivation by enhanced indoor means such as hydroponic systems. The commercial thresholds are lower than for outdoor growing.
Possession of precursors
Charges under s 24A of the Drug Misuse and Trafficking Act 1985 (NSW), based on possessing chemicals or apparatus intended for use in manufacturing a prohibited drug.
Possession of drug manufacturing equipment
Charges based on apparatus found at a property, such as tableting or extraction equipment.
Commercial and large commercial quantity offences
The most serious tiers, heard in the District Court and carrying the highest maximum penalties.
Manufacture And Cultivation Penalties In NSW
As with supply, the penalty is driven by the tier, and for cultivation by the number of plants rather than by weight.
| Offence | Maximum Penalty |
| Manufacture of less than a commercial quantity, s 24(1) | Up to 15 years imprisonment |
| Manufacture of a commercial quantity, s 24(2) | Up to 20 years imprisonment |
| Manufacture of a large commercial quantity | Up to life imprisonment |
| Cultivation of less than a commercial quantity of cannabis, s 23(1) | Up to 10 years imprisonment. For prohibited plants other than cannabis the maximum is 15 years |
| Cultivation of a commercial or large commercial quantity, s 23(2) | Up to 15 years for a commercial quantity of cannabis and up to 20 years for a large commercial quantity. Higher maximums apply to plants other than cannabis |
| Possession of precursors, s 24A | Up to 10 years imprisonment |
The plant count thresholds for cultivation and the quantity thresholds for manufacture sit in Schedule 1 of the Act. For indoor cannabis cultivation the commercial quantity is between 50 and 199 plants and the large commercial quantity is 200 or more, which is lower than the outdoor thresholds because indoor growing produces higher yields.
Where a small number of plants is involved and the cultivation was for personal use, the matter may be capable of being finalised in the Local Court, where the sentencing exposure is far lower. The plant count is therefore worth close attention.
Possible Defences To A Manufacture Or Cultivation Charge
These charges often involve more than one person and a location that several people used.
No knowledge of the production
Living at, renting or visiting a property is not the same as producing drugs there. Where you did not know what was happening, the charge may not be made out.
Challenging the search of the premises
Searches of homes generally require a warrant. Where the warrant was defective or the search went beyond its terms, the evidence may be open to challenge.
Your role was not manufacture
Presence, or a peripheral role, is not the same as manufacturing. Reducing the role attributed to you can substantially change the sentencing range.
Disputing the plant count or quantity
Where the figure includes seedlings, dead plants or material that should not be counted, the charge may sit in a lower tier than alleged.
What Happens After Being Charged With Manufacture Or Cultivation?
These matters generally involve a longer investigation than a street level drug charge.
- Search warrant and seizure
Police execute a warrant at the premises and seize plants, equipment, chemicals and any records.
- Charge and bail
You are charged and a bail decision is made. Commercial quantity allegations are treated seriously at this stage.
- Analysis and plant counting
The material is analysed and any plants are counted, which sets the tier the charge sits in.
- Brief of evidence
The brief usually includes the warrant material, forensic results, surveillance, phone records and any admissions.
- Negotiations, hearing or trial
Your lawyer may negotiate on the role attributed to you or the quantity relied on, contest the matter, or prepare it for sentence.

Frequently Asked Questions
Not automatically. The prosecution has to connect you to the production itself rather than to the property, and being a tenant, occupant or visitor is not enough on its own. Where several people had access, that link can be difficult to prove. Knowledge of what was happening is central.
By the number of plants rather than by weight, with thresholds that lift the charge into the commercial and large commercial tiers. That means a modest looking grow can cross into serious territory faster than people expect. How the count was arrived at, including whether seedlings or dead plants were included, is worth checking.
Yes. Cultivation by enhanced indoor means, such as hydroponic systems or artificial lighting, is a separate offence under s 23(1A) of the Act. The commercial and large commercial thresholds for indoor cannabis are set lower than for outdoor growing, at 50 to 199 plants and 200 or more respectively, because indoor cultivation produces higher yields. Whether a particular setup meets the definition can be contested.
They are charges based on possessing chemicals or equipment said to be intended for manufacturing a prohibited drug, rather than on any drug being produced. The contest usually concerns intention, since many of the substances involved have lawful uses. What the items were actually for is the central issue.
It can, particularly where the number of plants is small and the matter is capable of being finalised in the Local Court. The purpose of the cultivation is relevant both to the charge laid and to the sentence. It does not make the conduct lawful, but it materially affects the realistic outcome.
Presence alone is not manufacture, and the prosecution has to establish participation rather than proximity. Where several people are charged over the same premises, the role attributed to each is often the main dispute. Reducing the role attributed to you can change the sentencing range substantially.
